1. Membership Agreement

  • 1.1 The Terms and Conditions set out the contractual relationship between Vistara and each individual Member.
  • 1.2 Capitalized terms are defined in Section 17 (Definitions) and others are defined contextually herein.

2. Membership

  • 2.1 Membership in CV is open to individuals who are above 2 (two) years of age at the time of joining the CV Program subject to express parental consent and to individuals who are otherwise competent to enter into contract as per the applicable law(s).
  • 2.2 CV Membership enrolment fee is waived until further notice.
  • 2.3 Only individual/natural persons are eligible for CV Membership and each Member can maintain only one CV Account. Corporations and other legal entities cannot be enrolled as CV Members. CV Membership is not transferable to any other individual, trust or estate. Enrolment of several persons in a single account (joint account) and multiple enrolments by a single person are not allowed. CV does not provide feature of a family accounts as of now, and therefore clubbing of accounts of multiple members of a family is not permitted.
  • 2.4 All CV Membership e-cards are personal and non-transferable.
  • 2.5 CV Base-Tier-Membership is valid from the date of issuance of the CV ID to a Member.
  • 2.6 In the event that more than one Membership number is assigned to the same individual (duplicate accounts), CV reserves the right to merge the two accounts. In the event the same e-mail id / mobile number is updated in more than one CV Account, then all such accounts will be deactivated. Such account(s) will be activated only when the respective CV Member(s) amends the respective email ids/mobile numbers. The mobile numbers and email ids will be verified through the two-factor authentication procedure of the CV Program such that each account has a unique email id/unique mobile number recorded against the same. Member(s) can amend their email id(s) / mobile number(s) by logging into their respective CV Account(s) online at airvistara.com.
  • 2.7 If benefits, facilities or arrangements are provided or made available to a Member as a result of his / her Membership, whether these are provided by Vistara or by any other Program Partner, such a Member will be personally liable for any and all costs, taxes, surcharges, fees, charges, claims or liabilities of whatever nature arising from the provision or availability or usage of such benefits, facilities or arrangements.
  • 2.8 CV Membership shall at all times remain the property of Vistara, and Vistara reserves the right at all times in its absolute discretion and without giving notice to any person, to refuse to grant Membership, to revoke Membership or refuse or withdraw an upgrade (as applicable) to any Tier of Membership with or without assigning any reason thereof.
  • 2.9 While CV will endeavor to ensure that the services, benefits, facilities and arrangements as expressed or advertised by Vistara and the Program Partners are available to the Members, CV does not warrant the same in any manner and will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision, whether whole or in part, of any such information, services, benefits, facilities or arrangements.
  • 2.10 When a Member seeks to use or obtain any of the services, benefits, facilities or arrangements offered, the provision of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the Program Partner providing the said benefits, facilities or arrangements and CV does not warrant, endorse, guarantee or assume responsibility for any such services, benefits, facilities or arrangements offered by a Program partner to the Members.
  • 2.11 A Member must quote his/ her 9-digit CV ID and name as mentioned on his/her CV Account when booking and checking-in for flights with Vistara and/ or using the services of a Program Partner. Failure by a Member to provide the required Membership information accurately when making such bookings or availing such services may result in the applicable CV Points not being credited to the CV Account and Vistara or its Program Partner will not be responsible in this regard.
  • 2.12 Only the Member is eligible to obtain information from CV relating to his/her Membership data including but not limited to travel data, CV Points accumulated, and class of travel flown by the Member.
  • 2.13 Members can cancel their CV Membership at any time by submitting the appropriate written notification to contactus@clubvistara.com, through their registered email ID. At the time of such cancellation, any outstanding CV Points, benefits and Privileges will be withdrawn and shall stand cancelled. Any such termination shall not relieve the Member of any continuing obligations such as negative balance etc. under these Terms and Conditions.
  • 2.14 A name change on the Member's record will be accepted upon written notification to CV. Proof of name change is required to be submitted in such cases. Members can update their personal details such as address, phone number, nationality, preferences, etc. online at www.airvistara.com in ‘My Account’ section.
  • 2.15 CV reserves the right to enroll only such individuals to its Membership who reside in certain countries and/or regions. Such countries and or regions are subject to change in Vistara’s sole discretion; however, reasonable advance notice will be given in circumstances where the removal of a country and/or region will affect the Membership of existing Members by publishing the same on the Website or by such means as may be determined by Vistara in its sole discretion.
  • 2.16 Continued participation in the program by a Member will be regarded as acceptance by such Members of current Terms and Conditions, as may be amended from time to time by Vistara in its sole discretion.

3. Enrolment

  • 3.1 An application to join CV deems the acceptance of all the Terms and Conditions.
  • 3.2 Applications will not be considered for enrolment if any of the details provided at the time of enrolment are found to be incorrect or incomplete.
  • 3.3 CV may accept or reject any application for Membership in its absolute discretion. If an application for Membership is rejected, then any benefit that may have earned to the applicant using a Membership will be null and void.
  • 3.4 Members are expected to ensure that they take appropriate care of their account details to prevent unauthorized persons from accessing their CV Account and are expected to inform CV immediately in writing if they become aware that someone has gained unauthorized access to their CV Account details.
  • 3.5 Minor Enrolment:
    • 3.5.1 In respect of Minors, parent’s/legal guardian’s consent is required to join CV.
    • 3.5.2 Each Member can enrol a Minor in their capacity as the parent or legal guardian of such Minor, to receive the benefits of membership to CV in accordance with and subject to the Terms and Conditions by submitting a consent form.     • 3.5.3 For the purpose of the Terms and Conditions, the expression “Parent” shall mean the biological or adoptive father and/or mother of a person and the expression “legal guardian” shall mean a person having the care of a Minor or of his/her property or both his/her person and property, and includes (i) a natural guardian; (ii) a guardian appointed by the will of the Minor’s father or mother; (iii) a guardian appointed or declared by a court of competent jurisdiction; and (iv) a person empowered to act as such by or under the applicable law or by a court of competent jurisdiction.
    • 3.5.4 In the case of event of death of an associated Member parent/guardian, the Club Vistara Member Service Centre’ must be promptly informed and all the associated Child/minor’s entitlement to benefits of membership will be delinked from the deceased Member parent/guardian membership and will be associated with the new Member parent/guardian based on the provided legal documents

4. Updating Account Information

  • 4.1 CV Members will be responsible to maintain the confidentiality of his/her own CV Account.
  • 4.2 It is the responsibility of the Member to advise the CSC or email at contactus@clubvistara.com of any correction in name and date of birth of the Member.
  • 4.3 Requests for changes/updation/correction by a Member should be accompanied by supporting legal documentation, as may be specified at the time of making the name, date of birth and gender change request.
  • 4.4 Members may also update their address, mobile number, email ID and preference details online by logging in at airvistara.com.
  • 4.5 Each CV member can add upto 8 nominees (family member/friend) in their respective account.
  • 4.6 The CV member may delete one or more nominees from his/her account by writing a request to contactus@clubvistara.com Once deletion request has been placed (for one or more nominees), the CV member cannot write a new request for nominee deletion before 180 days of the previous request.
  • 4.7 Members should not share their CV ID/details, login ID and password with anyone.
  • 4.8 Members agree to accept responsibility for all activities that occur through their CV Account.
  • 4.9 Members should take all necessary steps to ensure that the CV ID/details, login ID and password are kept confidential and secure and inform CSC immediately if they have any reason to believe that the same have become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.

5. Tiers & Tier Evaluation

  • 5.1 CV has 4 tiers, qualification to a higher tier is based on the Tier Points accumulated in the Member’s CV Account
    • 5.1.1 CV Base;
    • 5.1.2 CV Silver;
    • 5.1.3 CV Gold; and
    • 5.1.4 CV Platinum.
  • 5.2 Tier Points cannot be redeemed or utilized. Tier Points are accumulated by a Member into his/her CV Account upon flying with Vistara.
  • 5.3 Tier Points are calculated on the base fare and are exclusive of any taxes and surcharges.
  • 5.4 Tier Points cannot be accrued on promotions, Partner transactions, Award Flights and Upgrade Awards.
  • 5.5 Members of CV Base must accumulate 15,000, 25,000 or 35,000 Tier Points or 20, 30 or 40 flights within 365 days rolling period in order to upgrade to CV Silver, CV Gold or CV Platinum Tier respectively.
  • 5.6 The Silver/Gold/Platinum Tier status is valid for 365 days.
  • 5.7 If a Member does not accumulate the requisite qualifying Tier Points or number of flights to retain their respective Tier status by the end of the 365-days rolling-period, he/she will automatically revert to a Base/Silver/Gold Tier Member, as applicable.
  • 5.8 CV members will not earn Tier Points when booking Economy Lite fares. They will continue to earn CV Points as per their tier.

6. CV Points

  • 6.1 CV Points are earned based on the fare of a Vistara flight ticket, promotional bonuses and Partner activity.
  • 6.2 CV Points shall include CV Points accumulated by a Member into his/ her CV Account for flying on any Vistara flight and/or, CV Points accrued with Program Partners for the use of their services.
  • 6.3 CV Points are valid for a period of 36 months from the date of the flight. CV Points once expired cannot be reinstated.
  • 6.4 CV Points cannot be transferred between CV Accounts and cannot be clubbed with any other frequent flyer program.
  • 6.5 To accumulate CV Points, the Member must quote his/her CV ID at the time of making a booking and/or at the time of check-in.
  • 6.6 Award Flights do not qualify for CV Points, and the Members are required to check for any restrictions at the time of booking (refer section 9.6 on Award Flight)
  • 6.7 Redemption bookings are not eligible for accrual of CV Points on Vistara and/or any Partner Flights.
  • 6.8 Failure to give complete/correct information may result in the CV Points due for that activity not being credited to the Member's CV Account and the Member not receiving certain service benefits associated to their Tier status.
  • 6.9 CV Points will not be awarded where the flight booked is cancelled or rerouted due to any reason beyond the control of Vistara, including but not limited to weather delays.
  • 6.10 The responsibility to check that the CV Points and transactions have been properly credited lies with the Member. Members can check their CV Account statement by logging into their CV Account at Website.
  • 6.11 A Member cannot attempt to accrue CV Points for a flight which has accrued points/miles with any other frequent flyer program. However, in case of any such attempts, CV retains the right to reverse the earned CV Points in its sole discretion.
  • 6.12 All activities that are not tracked automatically at the time of travel may be credited later at Vistara’s discretion.
  • 6.13 Members are required to keep the original travel ticket and boarding pass for claiming missing CV Points until the appropriate flights reflect on their account statement.
  • 6.14 In case of any dispute about CV Points accrual, CV may require proof of travel on the relevant Sector including the boarding pass.
  • 6.15 Bonus CV Points accumulated from promotions will be credited at the end of the promotion period or as per the terms and conditions as may be prescribed under the respective promotions.
  • 6.16 Member should write to us at contactus@clubvistara.com within 90 in case of any discrepancies regarding CV Points.

7. Earning CV Points

  • 7.1 CV Members are required to wait for 7 days from the date of travel for CV points to be credited in their CV Account.
  • 7.2 The name on the e-ticket and the boarding pass should exactly match the name on the CV Account for the auto credit of CV Points or through retro claims.
  • 7.3 CV members will not earn Tier Points when booking Economy lite fares. They will continue to earn CV Points as per their tier
  • 7.4 Retro Claim
    • 7.4.1 A CV Member can file for a Retro Claim, seven (7) days after the flight and this option is available for 180 days from the date of travel.
    • 7.4.2 If Retro Claim is for a Program Partner, a Member may write to Vistara at contactus@clubvistara.com with an attached copy of the e-ticket or boarding pass within 180 days of successful flight completion.
    • 7.4.3 A Member’s Retro Claim is not valid for Redemption bookings.

8. Partnership

  • 8.1 In case of Partner Flights’ Retro Claim, CV Members should allow up to four weeks' time from the date of request for the CV Points to be credited to the Member’s CV Account. All such requests should be accompanied by the boarding pass and ticket copy.
  • 8.2 In case of codeshare flights, CV Points will only be earned for flights operated by airline Partner.
  • 8.3 Redemption booking and group bookings are not eligible for accrual of CV Points on Partner Flights.
  • 8.4 When a Member seeks to use or obtain any of the services, Benefits, facilities or arrangements offered by CV, the provision of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the provider of said Benefits, facilities or arrangements and CV does not warrant, endorse, guarantee or assume responsibility for any such services, benefits, facilities or arrangements offered by a Program Partner to the Members. For disputes related to credit of bonus CV Points through Program Partners, Members are requested to contact the Program Partners directly.

9. Redemption

  • 9.1 CV Points can be redeemed for Award Flights and Upgrade Awards on flights operated by Vistara and its Partner airlines only.
  • 9.2 Redemption for Award Flight is subject to seat availability at the time of booking.
  • 9.3 A Member can redeem an Award Flight only for up to 8 other individuals at one time.
  • 9.4 Taxes and fuel surcharges and fees shall be collected separately in the applicable currency. The mode of payment for all Award Flight related charges will be Visa, MasterCard and American Express credit cards only.
  • 9.5 Members can redeem CV Points for Vistara Award Flight/Upgrade Award upon accumulating a minimum of 500 CV Points in their CV Account. To view the chart for Award Flight on Vistara, click here. To view the chart for Award Flight on Partner Airlines, click here.
  • 9.6 Award Flight
    • 9.6.1 CV reserves the right to limit the number of seats made available for award travel per cabin per flight.
    • 9.6.2 Award Flights can be booked online by logging into www.airvistara.com. or by calling CSC.
    • 9.6.3 Award Flight tickets once confirmed shall be emailed to the Member on his/her registered email id. This is subject to receipt of the payment of applicable taxes, fees and carrier charges.
    • 9.6.4 Award Flight bookings cannot be exchanged for cash or refunded in the form of CV Points.
    • 9.6.5 Any change in the Award Flight booking like cancellations, flight/date change will be chargeable as per applicable fare rules.
    • 9.6.7 The validity of an Award Flight ticket will be as per the applicable fare rules as available on the Website.
    • 9.6.8 In the event of an Award Flight being cancelled by the Member, CV Points will be credited back to the Member’s CV Account within 24 hours of cancellation of the ticket after deduction of applicable CV Points. All relevant surcharges shall be refunded to the Member.
    • 9.6.9 CV Points will not be refunded in the case of “No Show” passengers for Award Flight.
    • 9.6.10 Revenue seat booking cannot be converted into an Award Flight booking and an Award Flight booking cannot be converted into a commercial booking.
    • 9.6.11 Request for any change in the booking or cancellations should be made 48 hours prior to the departure of the flight.
    • 9.6.12 Award Flight booking can not be a wait-listed ticket. An Award Flight booking cannot be used in conjunction with any other promotion, coupon, discount or offer being run by Vistara or its Program Partners.
  • 9.7 Upgrade Award
    • 9.7.1 Upgrade Award can only be redeemed on an already existing Vistara commercial flight booking.
    • 9.7.2 An Upgrade Award is subject to seat availability in the desired cabin class at the time of request for upgrade.
    • 9.7.3 Upgrade Awards can be redeemed by calling the CSC on all days between 9AM – 6PM or directly at the Airport Ticketing Office.
    • 9.7.4 To view the Upgrade Award chart, click here.
    • 9.7.5 Upgrade Award tickets once confirmed shall be emailed to the Member on his/her registered e-mail id in case the upgrade has been requested through CSC.
    • 9.7.6 Any change in the upgraded flight booking like cancellations, flight/date change will be chargeable as per the fare rules of the commercial ticket.
    • 9.7.7 Upgrade Awards cannot be exchanged for cash.
    • 9.7.8 In the event of an Upgrade Award being cancelled by the Member, CV Points will be credited back in the Member’s CV Account within 24 hours of cancellation with deduction of applicable penalty of CV Points.
    • 9.7.9 CV Points will not be refunded in case of a “No Show” passenger.
    • 9.7.10 Upgrade Award cannot be further upgraded to higher Cabin Class by paying the commercial fare difference or CV Points..
    • 9.7.11 Except as stated herein, all other terms and conditions as specified on the Website including the conditions as applicable to CV Members shall be applicable to the Upgrade Award.
    • CV 9.7.12 Points cannot be used for re-routing the already booked flights.
    • 9.7.13 Passengers travelling with infants on Upgrade Award flight will need to pay the Infant fee of the upgraded class.
    • 9.7.14 If there are any changes in the ticket at the time of check-in at the airport, CV Members are not eligible for bonus CV Points on web/mobile app check-in offer.
    • 9.7.15 CV Points cannot be used to upgrade to the next cabin class when booking Economy Lite fares

10. Membership Audit and Termination

  • 10.1 CV also retains absolute discretion to suspend or terminate any Membership account, or to withdraw any CV Points accumulated as a result of such transactions as laid out in 14.4 below.
  • 10.2 The commission of a fraudulent, irregular, dishonest or suspicious transaction which shall include but not be limited to:
    • 10.2.1 altering documents to procure CV Points;
    • 10.2.2 knowingly supplying incorrect information to accrue CV Points;
    • 10.2.3 attempting to procure CV Points for flights which have not been flown or are not eligible for CV Points;
    • 10.2.4 using or attempting to use stolen or counterfeit tickets; or
    • 10.2.5 In the sole opinion of Vistara, the Member has acted frequently or in any member that is unacceptable to Vistara in relation to his/her Membership.
  • 10.3 If such Member is or has been put on ‘no fly list’ by any airline. Club Vistara privileges will not be valid during the period for which the member has been put on ‘no fly list’
  • 10.3.1 the commission of any misconduct which may include but shall not be limited to:
    • 10.3.1.1 failure to comply with these Terms and Conditions and/or Vistara’s Conditions of Carriage appearing on the Website (“Conditions of Carriage”);
    • 10.3.1.2 misuse of the services and/or Benefits which are available to Members from time to time; or
    • 10.3.1.3 the use of threatening, abusive or insulting language or behaving in a threatening, abusive or insulting manner when dealing with any of Vistara’s staff members or its agents or staff members of participating companies or Program Partners.
  • 10.4 Vistara retains the right to terminate any Membership in the event of any breach of CV Terms and Conditions and such termination will forfeit the Member’s right to future participation in the Program.
  • 10.5 Any booking made by a Member using his/her CV Points (an Award Flight) either before or after the date of breach will be subject to review and, where any Award Flight booking has been made using CV Points obtained fraudulently or otherwise in breach of these CV Terms and Conditions, Vistara reserves the right to cancel such booking.
  • 10.6 Upon the discovery of any breach of CV Terms and Conditions, as an alternative to termination of Membership, Vistara may (at the Vistara’s sole discretion) impose reasonable conditions on any future booking of Award Flights by such Members. Such conditions may include, without limitation, the deduction of CV Points, the deduction of Tier CV Points and/or downgrading the Tier of the Member.
  • 10.7 Membership enrolment and eligibility, accumulating CV Points, award travel, availability of awards and redemption are subject to the terms and conditions of CV and are subject to any applicable laws and regulations, including those of the International Air Transport Association (IATA) and the International Civil Aviation Organization (ICAO), as applicable. Vistara may change, add to, modify or withdraw at any time without giving notice, such terms and conditions as well as any Benefits provided in connection with CV and any special offers or promotional offers made to any Tier or group of Members.
  • 10.8 CV and its Program Partners reserve the right to change rules, regulations, awards travel, and special offers at any time without notice and without assigning any reason thereof.
  • 10.9 A Member can call CSC to cancel his/her Membership.
  • 10.10 If a Member cancels his/her CV Membership or his/her Membership is terminated in accordance with these Terms and Conditions, any CV Points which have not been redeemed will automatically expire and will not be redeemable from the date of such cancellation/termination of Membership.
  • 10.11 Upon the death of a Member, the CV Membership account will be closed. CV points earned but not redeemed at the time of death, as well as benefits and privileges, will be automatically forfeited on the death of the Member. However, the Member's legal heir, upon production of relevant documents, can redeem the CV Points available in the deceased's CV Account till such time that they are valid for redemption.
  • 10.12 Audit:
    • 10.12.1 CV reserves the right to audit any accounts at any time for compliance with the Program's Terms and Conditions without prior notice being given to the Member.
    • 10.12.2 If upon the audit carried out of any Member’s CV Account, it is discovered that there are any discrepancies or violations of Terms and Conditions or Conditions of Carriage, all accumulation and/or redemptions will be suspended until the matter has been resolved to the satisfaction of Vistara.
  • 10.13 CV reserves the right to (a) suspend, (b) permanently exclude a Member from further participation in, or (c) terminate his/her Membership with CV upon the occurrence of any of the following events:
    • 10.13.1 In the sole opinion of Vistara, the Member has misbehaved on any flight (whether or not a Vistara flight) or at any airline premises or at any airport. Misbehavior includes but is not limited to verbal or physical abuse of airline employee(s) or airline agent(s) or passenger(s), destruction or damage to property on any aircraft or at airline premises, or at any airport.
    • 10.13.2 Vistara bans the Member from its flights permanently or for a specified period of time.
    • 10.13.3 The Member has contravened any term or rule of Membership of CV.
    • 10.13.4 The Member has breached any Conditions of Carriage.
  • 10.14 If the Membership is suspended, any CV Points accrued shall also be suspended. If the Member is permanently excluded from Membership or has his/her Membership terminated in CV, any CV Points accrued shall be revoked and forfeited without entitlement to any compensation. In the event, Member is suspended or permanently excluded, or the Membership is terminated, the Member shall be liable for all damages, litigation and transaction costs.

11. Current Offers

  • 11.1 Refer a Friend
    • 11.1.1 Referral offer is valid only on referrals till 31st March 2019.
    • 11.1.2 The referred friend has to provide the CV ID of the referring Member in the referral ID section of the enrolment form.
    • 11.1.3 Referral offer CV Points will be credited to referring Member’s CV Account post the successful first flight of the referred Member.
    • 11.1.4 Under this offer, the CV Points for a maximum of 5 successful referrals will be credited to the CV Account of the referring Member.
    • 11.1.5 CV ID of the referred Member must be furnished at the time of booking or check-in for the referring CV Member to receive bonus CV Points under the offer.
    • 11.1.6 Offer is only valid on Vistara flights.
    • 11.1.7 Offer is not valid for referral of Minors.
    • 11.1.8 All offers, and promotions are subject to change without any prior notice and may not be combined with any other offers or promotions and have no cash value.
    • 11.1.9 All other CV rules remain applicable.
  • 11.2 Play and Earn
    • 11.2.1 Play and Earn CV Points will be credited to the CV ID within 30 days.
    • 11.2.2 Under this offer, CV Points of maximum 500 can be earned per CV ID till 31st March 2019.
    • 11.2.3 Accuracy of the data shared on the Play and Earn section is the sole responsibility of the CV Member.
    • 11.2.4 All offers, and promotions are subject to change without any prior notice, and may not be combined with any other offers or promotions and have no cash value.
    • 11.2.5 All other CV rules remain applicable.
  • 11.3 Complimentary Tier Match
    • 11.3.1 Tier-Match is valid for 3 months from date of issue.
    • 11.3.2 Post Tier Match evaluation, the Member will either be upgraded to CV Platinum or CV Gold or moved to CV Silver for a period of 12 months from the date of Tier evaluation.
    • 11.3.3 Complimentary Tier Match can only be provided once for every CV ID.
    • 11.3.4 It is the Member’s sole responsibility to comply with the terms and conditions of any other frequent flyer program that he/she may be enrolled with.
    • 11.3.5 It is Member’s sole responsibility to ensure that there is no conflict with terms and conditions of the other frequent flyer program before enrolling with CV Program.
    • 11.3.6 Benefits for Complimentary Tier Match do not include cabin upgrade and lounge access vouchers.
    • 11.3.7 During the evaluation period, Complimentary Tier Match members can enjoy all other benefits of CV Gold Tier.
    • 11.3.8 Member will have to submit scanned copy of other frequent flyer program with validity date or account statement of other frequent flyer program, thereafter the CV Member would be upgraded to complimentary CV Gold tier for a period of 3 months.

12. Limitation of Liability

  • 12.1 CV, Vistara and/or Program Partners shall not be liable to any Member or his/her Nominee or companion or any person deriving rights through the Members in CV Membership in accordance with these Terms and Conditions, for any indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with the CV Program and/or the provision or the refusal to provide any Benefits, whether such loss, damage or expense is caused by the negligence or otherwise, and whether CV, Vistara and/or its Program Partners have any control over the circumstances giving rise to the claim or not.
  • 12.2 CV will endeavor to ensure the availability of services provided by Vistara and Program Partners to the Members, but it does not warrant the same in any manner and will not be liable for any loss arising from the failure by Vistara or any other Program Partners to provide the said services.
  • 12.3 To the extent permissible by local law or regulation, these Terms and Conditions shall be governed by and construed in accordance with Indian law. Vistara and each Member submit to the -exclusive jurisdiction of the courts of Delhi to resolve any disputes that may arise between them.
  • 12.4 Any part of these Terms and Conditions which is unenforceable for any reason shall be considered capable of being cut out so as not to affect the remainder of these Terms and Conditions in any way. CV or Vistara shall not be required to provide any service or otherwise act in pursuance of these Terms and Conditions if to do so would be contrary to law.
  • 12.5 Reasonable care has been taken to ensure that information contained in the Terms and Conditions and in any publications and advertisements in connection with CV is accurate, but CV or Vistara will not accept any liability with respect to any errors or omissions in any information, whether written or verbal.

13. CV information on the Website/ Mobile App and through newsletters

  • 13.1 CV will regularly review and update the information on its web pages. Despite its best endeavors, it is possible that some of the information could meanwhile have become outdated. CV therefore cannot accept any responsibility for or guarantee that the information provided is up-to-date, correct and complete. Subject to the aforesaid, CV all Terms and Conditions are applicable to the Members at all times.
  • 13.2 CV reserves the right to make changes or additions to the information, services, including the information available on its web pages, products and other materials provided.
  • 13.3 It is the Member’s responsibility to periodically read and keep himself/herself updated about the then applicable Terms and Conditions and other relevant information about or related to his/her Membership or related entitlement available on the Vistara and/or its Program Partner and/or participating company’s web pages.
  • 13.4 Any e-communication from Vistara or CV received by a Member is intended only for the person or entity to which it is addressed and may contain confidential and/or privileged information. If you have received the message in error, please notify Vistara/CV immediately at contactus@clubvistara.com and delete the message from your system. Any unauthorized disclosure; copying, distribution or use of the message is strictly prohibited, and if done, will result in strict legal action. The message is not guaranteed to be complete or error free. No liability is assumed for any errors and/or omissions in the contents of this message. Reasonable precautions have been taken to ensure that the message is virus-free. However, Vistara and CV do not warrant the same in any manner or accept responsibility for any loss or damage arising from the use of the message or attachments.

14. Data Privacy

  • 14.1 By using/quoting his/her CV ID to Vistara and / or any Program Partners, a Member consents to CV creating, maintaining and updating data that is personal to the Member. Such data includes Membership data like name, address, telephone number, date of birth, seat preferences, etc., travel data (including without limitation, flights taken, CV Points accumulated and class of travel flown) and data concerning contacts with Vistara (including without limitation, enquiries regarding Membership) and such data will be maintained and updated for the purpose of providing relevant information and services to the Member. Data will also include data received from Program Partners about CV Points earned by Members as a result of using services provided by Program Partners.
  • 14.2 Before any data relating to a Member is disclosed to the same Member by CV, the Member may be asked security questions, which may require him / her to confirm his / her identity by providing information held by CV.
  • 14.3 CV may disclose data relating to a Member to a third person who has been nominated or authorised in writing (from registered email ID) by the Member to CV in advance.
  • 14.4 Members are responsible for the security of their CV ID/details, login ID and passwords and shall ensure that their CV ID/details, login ID and passwords are not disclosed by them whether intentionally or not, so as to allow a third person to access their CV Account and to make any transactions. In the event a Member suspects or becomes aware of any unauthorised use of his/her account or that his/her password is no longer secure, such Member must notify CV in writing immediately to contactus@clubvistara.com
  • 14.5 In an effort to provide valuable offers to Members, CV develops mailing lists for use by themselves and their Program Partners. These lists are based on information provided by the Member at the time of enrolment. These lists are developed under strict conditions designed to safeguard the privacy of Member's information. Members will be contacted on their email address / mobile number /landline phone numbers registered in the CV Account, based on their consent given at the time of enrolment or updated later on www.airvistara.com. If a Member does not wish to receive these offers, he/she may request in writing to have his/ her name removed from the said mailing lists by contacting the CV Member Service Centre. In the event, any Member visits any third-party web site(s) including the Program Partner website(s) pursuant to mails received under this provision or any third-party links provided on Vistara webpage and submits their information to any of those sites, the usage of such information will be governed by their respective website usage terms including privacy policies. Members must carefully read the privacy policy of any such website they visit, and CV will not be responsible for the same in any manner whatsoever.
  • 14.6 As a part of providing value added services to the CV Members, CV in collaboration with its Program Partners reserves the right to send special offers / products to the Members, based on their profile as recorded in his CV Account.
  • 14.7 Consent to receive such offers will be deemed as given, until such time that the Member withdraws consent to receive mailers and offers from Vistara and its various Program Partners by opting out of the relevant preference, either by writing to the CV Member Service Centre or on contactus@clubvistara.com. Withdrawal of consent may mean that certain services may no longer be provided to the Member.
  • 14.8 Any and all information in a Member's CV Account may be disclosed as required by law, including disclosures to the police, immigration and customs authorities.
  • 14.9 In order to maintain CV Membership, Vistara needs to collect, use and disclose the personal data of each Member in order to fulfill the following purposes:
    • 14.9.1 To provide Members with Membership status updates and other account-related information;
    • 14.9.2 To facilitate Membership-related transactions and services;
    • 14.9.3 To market and communicate to Members about Vistara and CV promotions, contests, events, and lucky draws, including those conducted by Vistara Program Partners;
    • 14.9.4 To contact Members about product or Member-related surveys and market research; and
    • 14.9.5 Other purposes as listed in the Vistara Privacy Policy at www.airvistara.com
  • 14.10 In connection with the above, some of the Members’ personal data may be disclosed to Vistara’s suppliers, service providers and other partner companies in the CV Program for Membership, flight booking related purposes and to provide the requisite service to the Members. The data collected will be used for direct marketing purposes by only Vistara and only if Members have given prior consent to Vistara to receive such marketing materials. Members who have given consent can subsequently request Vistara not to use their personal data for such marketing purposes by submitting a request in writing via Vistara’s online feedback form, or by logging into www.airvistara.com to update their communication preferences.

15. Vouchers

  • 15.1 Delivery of the physical card and/or vouchers will be made only to addresses of the Members within India as mentioned on the CV Account at the time of tier movement.
  • 15.2 Any dispute related to vouchers should be raised within the 30 days of voucher issuance.

16. Program Modification

  • 16.1 CLUB VISTARA MAY AT ANY TIME, WITHOUT GIVING NOTICE, MAKE ANY CHANGE, ADD TO, MODIFY THE CV PROGRAM, THE TERMS AND CONDITIONS AS WELL AS ANY BENEFITS PROVIDED IN CONNECTION WITH THE CV PROGRAM INCLUDING ANY SPECIAL OFFERS OR PROMOTIONAL OFFERS MADE TO ANY TIER OR GROUP OF MEMBERS, INCLUDING:
    • 16.1.1 Change the CV award structure by revising the CV Points required to attain a particular award;
    • 16.1.2 stipulate a specified period during which CV Points cannot be redeemed
    • 16.1.3 limit the number of seats available for the redemption of CV Points to any or all destinations or on certain specified flights;
    • 16.1.4 alter the number or types of journeys required to obtain a particular CV award
    • 16.1.5 change or withdraw Program Partners' affiliations, change the parties from which a CV Points award may be obtained / redeemed
    • 16.1.6 change the length of time after being awarded CV Points within which such CV Points must be redeemed
    • 16.1.7 impose a time limit upon the validity for redemption of any CV Points issued by CV or any Program Partners
    • 16.1.8 introduce and or review Membership fees
    • 16.1.9 modify the procedures and rules relating to ticketing on redemption of CV Points or other aspects of the CV Program
    • 16.1.10 change the manner in which CV Points may be earned and / or redeemed,
    • 16.1.11 change awards or Benefits including restrictions on the same impacting partner affiliations, change rules for earning CV Points, change rules for redemption of awards against CV Points
    • 16.1.12 change the continued availability of awards, introduce blackout dates or limit the seats available for award travel to any or all destinations (including, but not limited to, introducing a fixed number of seats to be awarded on certain flights)
    • 16.1.13 change the terms and conditions governing the use of Upgrade Vouchers or any other aspect of the CV Program.
  • 16.2 In the event CV makes any changes to the CV Program, it shall be the Member’s responsibility to update himself/herself at all times about such changes.
  • 16.3 Membership enrolment and eligibility, earning CV points, award travel, availability of awards and redemption are subject to the Terms and Conditions as provided herein and are subject to any applicable laws and regulations.

17. Definitions

  • 17.1 In addition to the terms defined in text of these Terms and Conditions, unless repugnant to the meaning or context thereof, the following words and terms shall have the meanings set out below::
    • 17.1.1 'Award Flight' means flight taken by redeeming CV Points.
    • 17.1.2 'Benefits' mean any of the facilities, discounts, services or arrangements offered or available to a Member as a result of Membership in the CV Program or its sub-programs introduced from time-to-time, including earning and redeeming CV Points which shall be subject to the terms and conditions applicable for the relevant Benefits.
    • 17.1.3 ‘Commercial/Revenue Flight’ means a flight providing scheduled or non-scheduled air transport services to the public for the carriage of passengers or cargo in exchange for monetary remuneration.
    • 17.1.4 ‘Complimentary Tier Match’ means a 3 (three) month complimentary CV Gold Membership to elite tier members of other frequent flyer programs.
    • 17.1.5 ‘CSC’ means Vistara’s 24*7 Member service centre which can be reached at +91 9289228888 or +91 9958962222.
    • 17.1.6 ‘CV Account’ or ‘Membership Account’ means account
    • 17.1.7 ‘CV’ or ‘CV Program’ or ‘Program’ means frequent flyer program established and maintained by TSAL whereby CV Members can accrue CV Points in conjunction with flight and non-flight activities.
    • 17.1.8 ‘CV ID’ means the 9-digit Membership number issued by CV which can be used to access the CV Account or undertake accrual or redemption or other activities, as applicable, through CV.
    • 17.1.9 'CV Points' mean the points/credits denominated as the points earned by a Member or awarded to a member and credited to a Member's CV Account.
    • 17.1.10 'Earn' means earning of CV Points/Tier Points every time a Member flies with Vistara.
    • 17.1.11 'Elite Tier Qualification' happens when a Member has collected enough Tier Points or has flown enough qualifying flights to either maintain the tier or move up to the next level.
    • 17.1.12 ‘Infant(s)’ means children below 2 years of age as on the date of travel.
    • 17.1.13 ‘Member’ or ‘CV Member’ means natural person who avails the Membership of the CV Program as per the Terms and Conditions.
    • 17.1.14 'Membership' means membership of the CV Program.
    • 17.1.15 ‘Minor’ means anyone above 2 (two) years and below 18 (eighteen) years of age.
    • 17.1.16 ‘Nominee’ means a person authorized by the Member and who will be able to make and change bookings for themselves.
    • 17.1.17 'Partners' mean Program Partner and all the other airline partners and non-airline partners of Vistara.
    • 17.1.18 'Privileges' are special rights or advantages, granted or available only to a particular person or group.
    • 17.1.19 ‘Program Partners’ include CV Program partners like Axis Bank, Singapore Airlines and SilkAir.
    • 17.1.20 ‘Redemption’ means redeeming CV Points for rewards, i.e., Award Flights or Upgrade Awards.
    • 17.1.21 'Retro Claim' means the claim made by CV Members for CV Tier/ Points from flights taken in the past 180 days.
    • 17.1.22 'Sector' means a single direct eligible flight sector between two destinations, e.g.: Delhi-Kolkata.
    • 17.1.23 ‘Terms and Conditions' means these CV Terms and Conditions as may be amended from time to time in the sole discretion of Vistara.
    • 17.1.24 'Tier' means CV Base, Silver, Gold and Platinum and as amended from time to time by CV as per its multi-tier program.
    • 17.1.25 'Tier Points' are the points used to evaluate the Tier level of the Member and can be earned only on booking commercial Vistara flights.
    • 17.1.26 'Upgrade Award' means CV Points used for cabin upgrade on Vistara or its airline Partners.
    • 17.1.27 'Vistara' means the brand name under which flights are operated by TSAL.
    • 17.1.28 ‘We’ / ‘our’ / ‘ourselves’ / ‘us’ / ‘TSAL’ means TATA SIA Airlines Limited.
    • 17.1.29 ‘Website’ means the website of TSAL, that is, www.airvistara.com, on which the Customers can purchase Tickets and also access information about TSAL and Conditions of Carriage.
